BengalLink Job Posting System

  1. Access to student/alumni resume books on BengalLink is to be utilized for employment purposes only.
  2. BengalLink is not a source for posting of training or post graduate education and teach/study/intern abroad programs.

Internships

Recent lawsuits regarding unpaid internships may determine how you post the internship. We encourage you to consult the US Fair Labor Standards Act (FLSA) as well as the National Association of Colleges and Employers (NACE) guidelines on internships.

  • Unpaid Internships

For-profit organizations are asked to review the following on unpaid internships. According the U.S. Department of Labor (DOL), an unpaid internship will not violate the Fair Labor Standards Act (FLSA) if it is a training program which meets the following criteria:

    1. The training, even though it includes actual operations of the facilities of the employers, is similar to that which would be given in a vocational school.
    2. The training is for the benefit of the student.
    3. The student does not displace a regular employee, but works under the close observation of a regular employee or supervisor.
    4. The employer provides the training and derives no immediate advantage from the activities of the student; and on occasion, the operations may actually be impeded by the training.
    5. The student is not necessarily entitled to a job at the conclusion of the training period.
    6. The employer and the student understand that the student is not entitled to wages for the time spent.

A student/intern not meeting all of the above criteria may be considered an employee covered by the FLSA, thus obligating the internship site to compensate that individual according to federal employment laws governing things like minimum wage and overtime. However, application of the FLSA to any particular program may be complicated and it is essential for internship sites to work closely with their own legal counsel to ensure compliance with applicable laws.

  • Paid Internships

An employee is an individual who is hired to perform a job or service on a full-time or part-time basis and is paid for the performance of his or her duties by the employer. If a student is hired as an employee, the US Fair Labor Standards Act (FLSA) requires that he or she is paid at least minimum wage. Please refer to the US Department of Labor Wage and Hour Division.

Unpaid/Volunteer Positions

Not-for Profit organizations that offer volunteer opportunities are allowed to post them on BengalLink. Unpaid/volunteer opportunities that do not fall under this definition may not be posted, unless it is an unpaid internship that meets all internship guidelines listed above.

Commission Only/Entrepreneurial Opportunities

Commission sales positions may be advertised to students and alumni through BengalLink, group information sessions, and job fairs provided that the compensation arrangement is clearly noted on job listings and is thoroughly explained in recruiting conversations and interviews with students.

Organizations with multiple direct sales representatives may only have one primary recruiter as determined by the CAPE and the organization.

Third Party Recruiters

Third Party recruiters can post on BengalLink if they identify the client in the posting for which they are hiring. When requesting access to BengalLink, resume books will not be made available.

  • Third Party recruiters must select "Human Resource & Staffing" as the Industry on the Employer Registration form.
  • When posting positions in BengalLink, the client name must be listed in the job title.
  • Student and alumni information must not be provided to any other employer or used for any other reason than the original recruiting purpose.
  • Third-party recruiters charging fees to Buffalo State students and alumni will not be permitted to post positions or have access to any CAPE services.

Employment Job Matching Websites/Services

The CAPE does not allow an organization access to BengalLink when only used to promote a specific job search engine or employment matching service. Examples might include:

  • Sites that match tutors, teachers, nannies, work from home positions, etc.
  • Job search engine promotion

Only positions for employment vacancies within the organization will be approved. Advertisements to become a user/registrant on the site will not be approved.
